This platform, which includes the website located at https://namyapress.com, all sub-domains, mobile applications, and associated services, is owned and operated by Namya Press Private Limited (“Namya Press”, “Namya”, “Company”, “Us”, “We”). By accessing or using our platform and services, you agree to be bound by these Terms of Service (“Terms”), and any additional policies or guidelines applicable to your use.

Please read these Terms carefully before proceeding. We may update these Terms at our discretion, and it is your responsibility to check this page periodically. Your continued use of the platform constitutes your acceptance of any updates.

These Terms constitute a legally binding agreement between you and Namya Press.

1. Acceptance of Terms

By accessing the Namya Press platform, you confirm that you are over the age of 13 and agree to these Terms. If under 13, you must only access the platform under appropriate parental or guardian supervision. Namya Press reserves the right to restrict access or terminate accounts for users not meeting these requirements.

If you are using the platform on behalf of an organization or institution, you represent and warrant that you are authorized to accept these Terms on its behalf and that the organization agrees to be bound by them, including indemnifying Namya Press for any liability arising from such use.

2. User Accounts

You may be required to create an account to access certain features of the Namya Press platform. You are responsible for maintaining the confidentiality of your login credentials and all activity under your account. Use of another person’s account or allowing others to access yours without permission is strictly prohibited.

Namya Press reserves the right to disable or delete accounts found to be in violation of these Terms or engaged in suspicious or unauthorized activities. 

3. Content Submission

You may upload and share content including manuscripts, cover designs, metadata, comments, and other materials. You retain full ownership of your original content but grant Namya Press a non-exclusive, royalty-free license to display, store, and distribute your content through our platform and partners, solely for the purpose of providing the service.

You are responsible for ensuring that your content does not violate any copyrights, trademarks, or third-party rights and is free of plagiarism. Namya Press will remove any content found to be infringing upon the rights of others.

4. Intellectual Property

All rights to the platform’s technology, visual design, branding, and backend systems are owned or licensed by Namya Press. You may not copy, distribute, or modify platform elements without our explicit written permission.

Users retain copyright of their books and content unless otherwise agreed in a separate publishing contract. Namya Press respects intellectual property rights and follows a takedown policy for violations.

5. Platform Use Guidelines

You agree to use Namya Press in accordance with these Terms and all applicable laws. Prohibited actions include:

• Uploading malicious code or engaging in hacking activities
• Attempting unauthorized access to the platform or its data
• Posting illegal, offensive, or plagiarized content
• Misusing the platform’s communication tools for unsolicited messages

Namya Press reserves the right to suspend or terminate access in cases of abuse, fraud, or legal violation and keep your royalty on hold.

6. Disclaimer of Warranties

Namya Press is provided “as is” without warranties of any kind. We do not guarantee uninterrupted access, accuracy of user-generated content, or availability at all times. Content and services may be updated or removed at our discretion.

We are not responsible for content posted by users or the actions of third-party services integrated into the platform.

7. Indemnification

You agree to indemnify and hold harmless Namya Press, its directors, staff, and affiliates from any claims, damages, or expenses arising from your use of the platform, submitted content, or breach of these Terms.

8. Limitation of Liability

To the fullest extent allowed by law, Namya Press shall not be liable for indirect, incidental, or consequential damages resulting from your use or inability to use the platform. Your sole remedy for dissatisfaction is to stop using the platform.

9. Fees & Payments

Some services on the platform may be offered for a fee. These fees are non-refundable unless otherwise specified. By selecting paid services, you authorize Namya Press to charge the applicable fees via the selected payment method.

Premium service fees are not refundable.

10. Shipping, Cancellation & Returns

Orders for physical books may be canceled only before Printing the books, shipment. Damaged or defective items may be returned within 7 days of receipt for replacement.

11. General Terms

• Amendments: These Terms may be updated without notice. Continued use implies acceptance.
• Waiver: Failure to enforce any right does not constitute a waiver.
• Severability: If any term is found invalid, the rest remain in effect.
• Governing Law: These Terms are governed by the laws of India. Disputes shall be subject to the jurisdiction of Delhi courts.
• Entire Agreement: These Terms represent the entire agreement between you and Namya Press.

To maintain a respectful, safe, and vibrant space for everyone, we’ve established the following Community Guidelines. Your participation on our platform means you agree to follow these rules.

Violations of these guidelines may lead to content removal, account suspension, or permanent bans, at our sole discretion.

1. User Behavior

• Respect every individual — no harassment, bullying, threats, or discrimination.
• Choose a username that is appropriate and does not contain offensive or discriminatory language.
• Criticism is welcome, but it must remain constructive and focused on ideas, not individuals.
• Do not engage in spam, mass posting, or the promotion of external products/services without approval.
• Do not post or link to illegal, pornographic, or violent content.
• Impersonation or misrepresentation of others is strictly prohibited.
• Doxing (sharing personal information) will lead to immediate suspension.
• Avoid using bots or services to manipulate your account’s popularity or engagement.
• Abusive or misleading behavior on third-party platforms may result in action on Namya Press as well.

2. Content Guidelines

• Hate speech or discrimination based on race, religion, caste, gender, nationality, or identity
• Content that promotes or glorifies violence, self-harm, or illegal activity
• Malware, harmful links, or phishing
• Plagiarized or copyright-infringing content

3. Advertising and Spam

• Do not advertise third-party services without prior approval
• Refrain from repetitive, irrelevant, or disruptive content
• Content found to be promotional or manipulative will be removed

4. Reporting & Feedback

If you come across content that violates these guidelines, report it to our support team. We will investigate and take appropriate action, which may include notifying the user or removing the content entirely.
